The bench, consisting of Justices P.S. Narasimha and A.S. Chandurkar, found no compelling ground to order a retest, upholding the earlier decision of the Madhya Pradesh High Court that had also rejected similar demands.
This verdict serves as a significant setback for candidates who claimed they were unable to attempt the paper fairly due to electricity disruptions at centres in Indore and Ujjain during the May 5 NEET UG exam. The affected students demanded either a fresh examination or special consideration in counselling. However, while acknowledging their concerns, the court ruled that a re-test cannot be ordered for isolated incidents unless there is clear evidence of widespread impact or procedural failure.
The National Testing Agency (NTA) and local authorities submitted that proper backup arrangements were made during the test, ensuring the overall environment remained under control. The top court stated that it must strike a balance between fairness to individuals and the integrity of a national examination process. Furthermore, the court made it clear that students who did not qualify for the merit list cannot participate in counselling through judicial orders.
It is important to note that over 22 lakh candidates across India appeared for NEET UG 2025, with only a small fraction (less than 100) of them reporting issues related to power outages at examination centres. The Madhya Pradesh High Court had already ruled against the demand for re-test on July 10, citing no measurable disadvantage in performance due to the isolated incidents of power outages.
The case title is XYZ v. National Testing Agency & Ors., and while this decision may be disappointing for some aspirants who were affected by the outage, it upholds the fairness and integrity of India’s national examination process.
